- Introduction
Welcome to the MEBENEZER LAB SL Affiliation Center, owner of the DIOXILIFE trademark. These terms and conditions govern your participation as an affiliate in our affiliate program. We ask you to carefully read this document before joining and participating in the program. - Cookie Duration
Our platform uses cookies to track affiliate referrals. The duration of our cookie is 30 days, meaning that when a referral makes a purchase within this period, the affiliate who recommended them will be eligible to receive commissions. - Commissions on Products
Commissions for sales made through your referrals may vary depending on the type of DIOXILIFE products purchased. Commissions will consist of the accumulation of balance within the affiliate centre, after 60 days from the confirmation of the referral you will be able to use it to make and redeem the balance in our shop for products. Specific commission rates will be detailed in your affiliate panel. It is important to note that only Dioxilife branded products, those that we manufacture, generate commission. Not included as commissionable products are filters, ormus, jugs, containers or any other that we do not produce, you can always ask us via chat or email if in doubt (info@dioxilife.com). - Disclosure of the Relationship
In accordance with applicable laws and regulations, as well as social media policies, affiliates must clearly and conspicuously disclose their relationship and material connection with MEBENEZER LAB and the DIOXILIFE brand in all promotions and advertising. You can use terms such as “ad” or “advert” before affiliate links, or any equivalent in your local language, such as “publicidad” or “anuncio” in Spanish. - Legal Compliance and Regulations
Affiliates must comply with all relevant laws, regulations, and guidelines in your country, in relation to the promotion and advertising of DIOXILIFE products. - Modification of Terms
We reserve the right to modify these terms and conditions at any time. Any changes will be notified to affiliates via their affiliate panel or via email. We recommend that you regularly review these terms to be aware of any updates. - Termination of Affiliation
Both affiliates and MEBENEZER LAB have the right to terminate the affiliation relationship at any time, for any reason, with prior written notice. In the event of a breach of these terms, MEBENEZER LAB reserves the right to terminate the affiliation without prior notice. - Code of Conduct for MEBENEZER LAB Suppliers
By participating in the Affiliate Program, you agree to comply with the code of conduct for MEBENEZER LAB suppliers. Be aware that this code may be updated and that you are responsible for being aware of any changes and complying with them.
At MEBENEZER LAB, we value collaboration with our affiliates and believe in the importance of maintaining the highest ethical and professional standards in our relationship. This Code of Conduct sets out the expectations and guidelines that all our affiliates must follow when promoting our products and services. By joining our affiliate program, you agree to comply with the following principles:
A. Transparency and Disclosure
As an affiliate of MEBENEZER LAB, you must clearly and honestly disclose your relationship with us in all your promotions. You should use tags such as “ad” or “advert” before affiliate links to indicate that you are promoting products in a remunerated manner. Transparency is key to maintaining your audience’s trust.
B. Legal Compliance
Comply with all applicable laws and regulations in your country and anywhere else you promote our products.
C. Honest Promotion
Do not make false, misleading, or exaggerated claims about our products or services. Promote in a sincere and authentic manner, and do not overstate the benefits of the products. Avoid any statement that may be confusing or misleading to your followers.
D. Product Knowledge
Before promoting our products, make sure you have adequate knowledge about them. Do not talk about products without a solid base and avoid making unproven claims about their performance or attributes.
E. Respect for Diversity
Do not promote content that is discriminatory or that encourages violence, hatred, intolerance, or discrimination based on race, religion, sexual orientation, age, gender, nationality, or any other personal characteristic.
F. Compliance with this Code
Non-compliance with this Code of Conduct may result in the termination of your affiliation with MEBENEZER LAB. We reserve the right to take appropriate actions if we detect violations of these principles. - Dispute Resolution; General Provisions
9.1 Audit Right; Suspension and Termination
MEBENEZER LAB has the right to audit you and your sites or activities related to your site, including compliance with this Affiliate Policy, in relation to your participation in the Affiliate Program. If MEBENEZER LAB believes you have breached this Affiliate Policy or engaged in fraudulent activity, it may take any measures it deems appropriate, such as: (i) issuing a notice; (ii) conducting an investigation; (iii) suspending your account; (iv) terminating your Affiliate Program account; or (v) withholding commission payments.
9.2 Indemnification
You agree to indemnify, defend, and hold harmless MEBENEZER LAB, its affiliates, and its subsidiaries, and each of their respective directors, members, executives, employees, contractors, representatives, agents, assignees, and authorized assignees from and against any and all damages, judgments, settlement payments, fines, and costs (including reasonable attorney’s fees) in connection with any third-party claim arising from or related to: (i) an act of negligence, misconduct, or intentional acts or omissions on your part; (ii) your breach of applicable laws or regulations, or corresponding codes of practice; (iii) your breach or any other non-compliance with the conditions of this Affiliate Policy, or (iv) your authorized channels and other content.
9.3 Limitation of Liability
Nothing in this Policy, including this section 9.3, shall exclude or limit liability that cannot be excluded or limited under applicable law. Subject to this, and to the extent permitted by applicable law, MEBENEZER LAB shall not be liable for indirect or special damages arising in connection with this Policy, the Affiliate Program, even if the possibility of such damages was made known to MEBENEZER LAB.
9.4 Representations and Warranties
You represent and warrant that (a) you have the necessary authority to participate in the Affiliate Program and sign this Agreement, and that you have sufficient rights to grant any express licenses herein; (b) you shall, in the performance of all your rights and obligations under this Agreement, comply with all applicable laws, regulations, and codes of practice; (c) any material or communication you display or use in connection with the Affiliate Program shall not (i) infringe copyright, patent, trademark, trade secret, or any other property right or publicity or privacy right of any third party; (ii) be defamatory; (iii) be lewd, pornographic, or obscene; (iv) violate any laws, including those relating to unfair competition, anti-discrimination, consumer economic protection, or false advertising; (v) promote violence or contain hate speech; (vi) promote discrimination based on race, age, sex, religion, nationality, sexual orientation, gender expression, or disability; or (vii) contain viruses, trojans, worms, time bombs, cancelbots, or other harmful programming routines.
MEBENEZER LAB MAKES NO REPRESENTATION OR WARRANTY TO YOU, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. MEBENEZER LAB MAKES NO EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE AFFILIATE PROGRAM OR ANY PRODUCT OR SERVICE SOLD THROUGH THE AFFILIATE PROGRAM, OR ANY COMMISSIONS YOU MAY EARN THROUGH THE AFFILIATE PROGRAM, OR THAT ANY MEBENEZER LAB SITE, THE AFFILIATE PROGRAM SITE, OR THE NETWORK WILL OPERATE UNINTERRUPTED OR ERROR-FREE. - Governing Law, Jurisdiction, and Venue
This Affiliate Policy is governed by the laws of the State of Spain. Any action related to this Policy or your participation in the Affiliate Program shall be held only in the courts located in Spain, and you irrevocably submit to the jurisdiction of such courts. - Related Policies; Contact and Communications
To participate in the MEBENEZER LAB Affiliate Program with the DIOXILIFE brand, you must subscribe in the affiliate section and give your consent by checking the option “I accept the terms and conditions” which we strongly recommend you to read carefully.
MEBENEZER LAB may directly contact Affiliates to inform them about news and basic offers of the program. If you no longer wish us to contact you, or if you want to leave the program, you should send an email to info@dioxilife.com.
MEBENEZER LAB reserves the right to change or modify the conditions included in this Affiliate Policy at any time. Any changes or modifications will take effect after posting the revisions through Affiliate Terms and Conditions. If you continue to participate in the Affiliate Program after such publication, it will be considered that you have accepted such changes.
